YOUR OBLIGATION – THE LEGAL DIRECTIVES
The German Federal Working Group on Waste (LAGA) defined the classification criteria for mail order and online retail packaging in 2008 already. According to this, packaging material that is used to transport goods and ends up with private end consumers is considered sales packaging that must be licensed with a dual system.
In particular, this includes all parcels and packages mailed by online retailers. Even when second hand cardboard boxes are used, i.e. boxes which have been used before and which have therefore already been licensed with a dual system at an earlier point in time,
it would be advisable to obtain another license from a dual system as mail order retailers may be asked to furnish proof of where and when this second hand packaging was licensed before.
Furthermore, all packaging materials must be licensed, meaning not only the cardboard box but also any filling material or bubble wrap.
Independent of the shop size, smaller online shops as well as major online mail order retailers must register their packaging with a dual system.

In our case, “licensing” means that a packaging material is introduced to a dual system. Germany’s dual system providers ensure that packaging is collected, sorted and recycled in a way that complies legally with the German Packaging Ordinance. These services cost money, of course – and the producer (the business that introduces the packaging to the cycle) is liable for these costs. Producers must register the packaging materials they introduce to the market with a dual system provider and pay for the collection, sorting and recycling of these packaging materials.
No, all packaging materials including filling material and bubble pack must be registered and licensed.
Basically, all sales packaging must be licensed. This means all packaging that is used to send the goods to the end consumer. This includes the following materials:
- Composite drink cartons
- Other composite packaging
- Natural materials
According to Section 3, Paragraph 1, No. 2 of the German Packaging Ordinance, all packaging sold as a sales unit with the goods will and occurs at the end consumer is classified as sales packaging.
According to Section 3, Paragraph 1, No. 4 of the German Packaging Ordinance, all packaging that makes goods easier to transport, protects them from damage during transport and/or is used for safety reasons is considered transport packaging. As all of these criteria also apply to sales packaging, the place where it arises is the criterion applied to classify packaging as transport packaging. Transport packaging accumulates at the retail end of the chain, and not at the private end consumer; it does not pass into the ownership of the consumer along with the goods they have purchased.
No, there is no minimum order value. Maximum order value is EUR 50,000.
Once the payment process has been completed and as soon as the invoice total has been credited to the ELS account, you will automatically receive your participation confirmation by email. This confirmation proves that you have paid legally compliant for the collection and recycling of your packaging and that ELS GmbH is now responsible for your obligations. It will also be accepted by government authorities as valid proof.
The invoice will be sent to you in PDF format automatically via email as soon as the payment process has been completed.
The ELS Verpackungsticket® is always valid until 31 December of the respective calendar year; ELS GmbH will be responsible for your obligations arising from the German Packaging Ordinance until that date.
You can now use our packaging ticket up to a shopping basket value of EUR 50,000 (gross). Please contact us directly in case your licensing volume exceeds EUR 50,000 (gross).
